This case involves some Petty Traders and Craft Men Association form Madina who petitioned CEPIL to intervene against the demolition of their structures and property by the Ga District Assembly.
On or about 03/03/04, the Ga District Assembly task force together with some policemen forcefully evicted and demolished structures belonging to members of the Petty Traders and Craft Men Association of Madina and in the process destroyed their property.
Members of the Association had acquired interest in the land form the land owners (La-Nkwantanang Family). The plaintiffs put up structures for purposes of dwelling and economic activities, paid levies in respect of the land to La Nkwantanang Town Development Association
A short notice was given by the District Assembly. The owners of the land had earlier assured the residents that they will not be associated by the demolition exercise.
They were nevertheless affected and were not given any opportunity to pick up their belongings. The Center, on behalf of the Plaintiffs, brought an action against the Ga District Assembly and the Attorney General of the Republic of Ghana, seeking damages for the violation of the Plaintiffs’ fundamental human rights to housing and their right to own property.
